February 4, 2020 Opinion or Order Filing 12 GENERAL SCHEDULING AND PRETRIAL ORDER. The parties' Rule 26(f) Planning Report (Doc. #11 ) is hereby APPROVED, with the following modifications: (1) All discovery shall be completed by November 30, 2020, and all other interim discovery dates set forth in the parties' Rule 26(f) Report are hereby adopted. Any dispositive summary judgment motions shall be filed by Friday, January 15, 2021, and any response to dispositive summary judgment motions shall be filed by February 15, 2021. The parties' joint trial memorandum is due by Friday, January 8, 2021, or within 30 days of the Court's ruling on dispositive summary judgment motions, whichever date is later. The Court will thereafter set a trial date, and the parties should be prepared to proceed to jury selection within 30 days of the filing of the joint trial memorandum. (2) The Court rejects the parties' proposed orders respecting preservation and waiver of attorney-client and work-product privileges, and will not enter any orders respecting waiver or potential waiver of privilege at this time. If the parties find themselves in a dispute concerning the scope and extent of privilege with respect to any particular items of discovery, they should avail themselves of the Court's existing mechanisms for the resolution of discovery dispute (which can be found on Judge Meyer's website).(3) Either party is permitted to file a dispositive motions, consistent with the deadlines set out above (or as otherwise provided by the Federal and Local Rules), without seeking the leave of court, meeting and conferring with opposing counsel, or requesting a pre-filing conference with the Court. This order does not displace each party's continuing obligation to conduct litigation in good faith, avoid vexatious or frivolous motion practice, and attempt to resolve disputes among themselves before involving the court.(4) The parties are directed to refer to Judge Meyer's webpage on the District of Connecticut website for Judge Meyer's "Instructions for Discovery Disputes" and "Instructions for Joint Trial Memorandum" and "Pretrial Preferences" and "Trial Preferences." (5) The parties are encouraged to commence discovery forthwith and to arrange their schedules in contemplation of the briefing deadlines for any dispositive motions, because the Court is unlikely to grant a future request for an extension of the scheduling order absent extraordinary and unforeseeable circumstances.(6) A telephonic status conference will be held on September 4, 2020, at 3:30pm.
