ORDER. Federal Rule of Civil Procedure 45(f) provides that "[w]hen the court where compliance is required did not issue the subpoena, it may transfer a motion [to compel] under this rule to the issuing court if the person subject to the subpoena consents or if the court finds exceptional circumstances." Plaintiffs' #1 motion to compel is made under Rule 45, and the subject of the subpoena, non-party Marcus Communications LLC, consents through its #31 motion. In addition, Plaintiffs have submitted a #33 response to the Court's order to show cause stating that they do not object to the Court transferring the case. Accordingly, non-party Marcus Communications LLC #31 motion to transfer the motion to compel under Federal Rule of Civil Procedure 45(f) is GRANTED.
