ORDER re #2 Application for Appointment of Appraisal Umpire filed by Liberty Mutual Insurance Company. Liberty Mutual Insurance Company requests that the Court appoint an umpire for an appraisal proceeding commenced by the parties to resolve a insurance claim. Respondents are Mark and Oksana Pukhovich. To date, the parties' appraisers have been unable to agree on a candidate who is qualified to serve as an umpire for the appraisal proceeding. Pursuant to the terms of the Policy and the FAA, Liberty Mutual requests that the Court choose an umpire from the list of candidates submitted. To further assist the Court, Liberty Mutual proposes that the parties further narrow the list of umpire candidates choosing one potential candidate from the other party's respective list, thereby leaving the Court with only two potential candidates from which to select an umpire. [Doc. #2, para. 15].The Court agrees. Accordingly, within fourteen (14) days, the parties will file a joint responsive pleading identifying two potential umpire candidates along with additional information relating to the candidates' qualifications, along with a concise statement addressing why that candidate is/is not qualified for the appointment.
