June 15, 2020 Opinion or Order Filing 9 ORDER: Plaintiff failed to establish that he met the requirements to proceed in forma pauperis when he filed his Complaint, and he failed to diligently prosecute his case, see Dkt. 6 dated 5/7/2020, with no response. But Plaintiff has indicted that he has been released and is no longer incarcerated, and due to the instability of being released from prison, the Court will indulge Plaintiff and not dismiss his case. If the Court did dismiss his case, Plaintiff could simply re-file as a non-prisoner, so the Court will allow him to file an updated, non-prisoner application to proceed in forma pauperis.
