"An injunction is a drastic and extraordinary remedy, which should not be granted as a matter of course." Monsanto Co. v. Geerston Seed Farms, 561 U.S. 139, 165 (2010). In addition, "[e]x parte relief under Fed. R. Civ. P. 65 by way of a temporary restraining order is an emergency procedure." Little Tor Auto Ctr. v. Exxon Co., USA, 822 F. Supp. 141, 143 (S.D.N.Y. 1993). Pursuant to Fed. R. Civ. P. 65(b), "[t]he court may issue a temporary restraining order... only if: (A) specific facts in an affidavit or a verified complaint clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition; and (B) the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required." Fed. R. Civ. P. 65(b) (emphasis added). Therefore, the granting of an ex parte request for a temporary restraining order is appropriate "where irreparable injury will be caused absent prompt judicial intervention in circumstances where the adversary cannot be contacted, or where advance contact with the adversary would itself [b]e likely to trigger irreparable injury." Dama S.P.A. v. Does, No. 15-cv-4528(VM), 2015 WL 10846737 at * 1 (S.D.N.Y. Jun. 15, 2015). The plaintiffs have failed to establish that "irreparable injury will be caused absent prompt judicial intervention." Id. Nor have the plaintiffs shown that "advance contact with the defendant would itself [b]e likely to trigger irreparable injury." Id.
