Date Filed Document Text
October 22, 2020 Opinion or Order Filing 11 ORDER taking under advisement #9 Motion for Extension of Time. Defendant has filed a Motion for Extension of Time until December 9, 2020, to file the Administrative Transcript. See Doc. #9 . Plaintiff consents to the requested extension. See id. at 1. Defendant asserts that delays caused by the COVID-19 pandemic prevent the OAO from producing the transcript, which is otherwise due to be filed by October 25, 2020, in a timely manner. See id. at 1-2. No motion for extension of time will be granted "except for good cause." D. Conn. L. Civ. R. 7(b)(1). "The good cause standard requires a particularized showing that the time limitation in question cannot reasonably be met despite the diligence of the party seeking the extension." Id. Defendant has made no showing of diligence in attempting to meet the existing deadline. Indeed, the motion does not indicate when, if at all, a request was made for preparation of the Administrative Transcript. Defendant shall file a Notice on or before October 27, 2020, stating the date on which preparation of the Administrative Transcript was requested, and offering any other pertinent information regarding the diligence exercised in attempting to meet the Court's deadline. It is so ordered. Signed by Judge Sarah A. L. Merriam on 10/22/2020. (Weis, Anne)

August 27, 2020 Opinion or Order Filing 7 ORDER granting #3 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without payment of fees and costs, which motion includes a sworn statement as to plaintiff's current financial circumstances. See Doc. #3 . Plaintiff has completed the required information. She asserts that she is unable to afford to pay fees and costs, having been unemployed since 2017. See id. at 3. Plaintiff asserts that she receives "Food stamps" and publicly funded health insurance. Id. Plaintiff further asserts that although she owns a two-family home, that home is in foreclosure, and the income she receives from the rental of that home does not cover her mortgage payment. See id. at 3-4. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #3 Motion for Leave to Proceed in forma pauperis is GRANTED. It is so ordered. Signed by Judge Sarah A. L. Merriam on 8/27/2020. (Spangenburg, S.)
