Filing 11 ORDER DENYING MOTION TO RE-OPEN CASE (Doc. #10 ). The Court DENIES the motion to re-open without prejudice to re-opening in the event that plaintiff chooses to pay the filing fee as required by the Court's prior order denying her motion for leave to proceed in forma pauperis (Doc. # 9 ). It is so ordered. Signed by Judge Jeffrey A. Meyer on 3/18/2021. (Freberg, B) |
Filing 10 MOTION to Reopen Case by Timolyn Deneen Dunbar.Responses due by 4/7/2021 (Attachments: #1 Envelope)(Payton, R.) |
Filing 9 ORDER DENYING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS (Doc. #8 ). The Court DENIES the motion for leave to proceed in forma pauperis on the ground that the motion shows that plaintiff has income of $1,832 per month that is well in excess of plaintiff's monthly expenses of $485 such that it is reasonable to require the plaintiff to pay the Court's filing fee if she wishes to proceed with this action. Although a plaintiff need not be absolutely destitute to proceed in forma pauperis, there has been no showing that the burden here would hamper Dunbar's ability to obtain the necessities of life or force her to abandon this action. See Sears, Roebuck & Co. v. Charles W. Sears Real Est., Inc., 865 F.2d 22, 23 (2d Cir. 1988); Walker v. Chapdelaine, 2017 WL 3669032 (D. Conn. 2017). Because the Court has previously closed this case, the case shall remain closed and subject to re-opening if plaintiff elects to pay the required filing fee. It is so ordered.Signed by Judge Jeffrey A. Meyer on 3/15/2021. (Freberg, B) |
Filing 8 MOTION for Leave to Proceed in forma pauperis by Timolyn Deneen Dunbar. (Attachments: #1 copy of letter & envelope) (Oliver, T.) |
Filing 7 ORDER DISMISSING ACTION. On February 8, 2021, the Court entered an order denying plaintiff's motion for leave to proceed in forma pauperis without prejudice to her payment of the filing fee or filing of a proper application by February 22, 2021 in order to avoid dismissal of this action. Doc. #6. The deadline has come and gone without a response. Accordingly, the Court DISMISSES this action without prejudice for failure to prosecute. If plaintiff has good cause for failing to comply with the Court's order, then plaintiff may file a motion to reopen this case by March 8, 2021 explaining why plaintiff has not complied with the Court's order, and any such motion to reopen shall be accompanied by plaintiff's proper motion for leave to proceed in forma pauperis or payment of the required filing fee. The Clerk of Court shall close this case. It is so ordered. Signed by Judge Jeffrey A. Meyer on 2/26/2021. (DeBot, B.) |
Set Deadlines: Dismissal due by 2/22/2021. (Gutierrez, Y.) |
Filing 6 ORDER DENYING WITHOUT PREJUDICE MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS (Doc. #2 ). Plaintiff has filed a motion for leave to proceed in forma pauperis stating that plaintiff has no income of any kind and that plaintiff has no expenses of any kind. Because these representations--especially the claim that plaintiff has no expenses of any kind for food, clothing, and shelter--are inherently implausible absent further explanation, the Court DENIES the motion for leave to proceed in forma pauperis. In order to avoid the Court's dismissal of this action, plaintiff shall pay the filing fee or file a renewed motion for leave to proceed in forma pauperis by February 22, 2021. In the event that plaintiff chooses to file a renewed motion for leave to proceed in forma pauperis claiming that she has no income or expenses, plaintiff shall explain how it is that she is able to have shelter, have clothing, and have food for subsistence, and if she is receiving assistance from any third party, she shall identify the amount(s) as well as the name, address, and telephone number of the third party so that the information may be verified. It is so ordered. Signed by Judge Jeffrey A. Meyer on 2/8/2021. (DeBot, B.) |
