ORDER DISMISSING CASE: Pro se plaintiff, Edmarys Luna, was made aware of two specific deficiencies with this case. On 2/1/2021, in Docket entries 8 and 9, the Honorable Sarah A.L. Merriam indicated that the plaintiff had failed to sign the motion to proceed in forma pauperis and that it appeared that this matter was not timely filed. In those same entries Judge Merriam provided the pro se plaintiff the opportunity to cure both deficiencies by 2/17/21. Plaintiff was warned that failure to do so could result in the dismissal of the case. An additional week has passed since Judge Merriam's deadline and plaintiff has failed to cure either deficiency in this case or otherwise indicate to the Court an intention to do so. ORDER. On January 28, 2021, the self-represented plaintiff filed a Complaint for Review of Social Security Administration Decision. (Doc. #1 ). Plaintiff alleges that the Appeals Council issued its decision on September 15, 2020. See Doc. #1 at 2. Based on that information, it appears that plaintiff's complaint may be untimely. In order to allow the Court to determine whether plaintiff has timely filed her complaint, on or before February 17, 2021, plaintiff shall file: (1) a copy of the Appeals Council decision; and (2) if applicable, a copy of any extensions granted by the Appeals Council for the filing of an action in the District Court.Failure to comply with this order may result in the dismissal of plaintiff's complaint. ORDER. Plaintiff has filed a #3 Motion for Leave to proceed in forma pauperis, seeking to proceed in this case without the payment of fees and costs. Plaintiff's motion includes a financial affidavit addressing plaintiff's current financial circumstances. See Doc. #3 at 2-5.Plaintiff's financial affidavit is not signed under the penalties of perjury, an essential requirement of the statute authorizing the commencement of an action without prepayment of fees or costs. See 28 U.S.C. 1915(a)(1); United States v. Copen, 378 F. Supp. 99, 103 (S.D.N.Y. 1974) ("Leave to proceed in forma pauperis may be obtainable only upon submission by the party of an affidavit made as required by that statute."). Plaintiff shall file a renewed Motion for Leave to proceed in forma pauperis together with a signed financial affidavit on or before February 17, 2021. Alternatively, plaintiff may pay the required filing fee on or before that date. Failure to file a renewed motion and signed financial affidavit, or alternatively to pay the required filing fee, will result in the dismissal of this case.It is so ordered. Signed by Judge Sarah A.
