February 25, 2021 Opinion or Order Filing 15 ORDER DISMISSING CASE: Pro se plaintiff, Edmarys Luna, was made aware of two specific deficiencies with this case. On 2/1/2021, in Docket entries 8 and 9, the Honorable Sarah A.L. Merriam indicated that the plaintiff had failed to sign the motion to proceed in forma pauperis and that it appeared that this matter was not timely filed. In those same entries Judge Merriam provided the pro se plaintiff the opportunity to cure both deficiencies by 2/17/21. Plaintiff was warned that failure to do so could result in the dismissal of the case. An additional week has passed since Judge Merriam's deadline and plaintiff has failed to cure either deficiency in this case or otherwise indicate to the Court an intention to do so. Plaintiff alleges that the Appeals Council issued its decision on September 15, 2020. See Doc. #1 at 2. Based on that information, it appears that plaintiff's complaint may be untimely. In order to allow the Court to determine whether plaintiff has timely filed her complaint, on or before February 17, 2021, plaintiff shall file: (1) a copy of the Appeals Council decision; and (2) if applicable, a copy of any extensions granted by the Appeals Council for the filing of an action in the District Court.Failure to comply with this order may result in the dismissal of plaintiff's complaint. Plaintiff's motion includes a financial affidavit addressing plaintiff's current financial circumstances. Alternatively, plaintiff may pay the required filing fee on or before that date.
