Plaintiff (Marcus Cameron), and Attorneys Cruz, McLane, Fiske, Vitale and (Eric) Gerarde were in attendance on behalf of their respective clients. No current objections were raised, but Attorney Cruz indicated that she would need to consult with Plaintiff prior to waiving any possible objections. The court acknowledged that the parties retain the right to object after consulting with their lawyers. The court then addressed the status of non-appearing defendants, the discovery timeline, and whether the parties are interested in a settlement conference. ORDER granting in part and denying in part #15 Motion for Extension of Time. The parties shall file their joint Rule 26(f) report on or before July 27, 2021, regardless of whether counsel for the State Defendants has filed an appearance by that date. Pursuant to Local Rule 26(f)(2): "If a defendant appears after the scheduling order is issued, such defendant shall be bound by the scheduling order unless it is modified by the Court either on its own initiative or on motion." Plaintiff is also directed to file a return of service for all Defendants pursuant to Local Rule 4(d) on or before July 23, 2021. Finally, counsel is reminded that pursuant to Local Rule 7(b)(3): "All motions for extension of time shall be filed at least three (3) days before the deadline sought to be extended, except in cases in which compelling circumstances warranting an extension arise during the three days before the deadline. Any motion for extension of time filed fewer than three days before the deadline sought to be extended shall, in addition to satisfying all other requirements of this Rule, set forth reasons why the motion was not filed at least three days before the deadline in question." Future failures to comply with Local Rule 7(b)(3) may result in the denial of non-compliant motions for extension of time without prejudice to refiling of a compliant motion. Signed by Judge Kari A.
