Filing 11 MOTION for Court to publish on JUSTI and PACERMONITOR the Plaintiff(s) "REBUTTAL/OBJECTION - WORD for WORD - TO DOC. ORDER #9 by John Verner Moran. Responses due by 5/26/2021 (Attachments: #1 envelope) (Agati, Kathryn) |

Filing 9 ORDER. The #8 motion for extension is hereby GRANTED. Moran shall pay the filing fee as directed in ECF No. 6 by June 18, 2021 or the case will be dismissed. To the extent the #8 motion seeks a reconsideration of the Court's decision denying Moran's motion to proceed in forma pauperis ("IFP motion"), the Court GRANTS the motion to reconsider and DENIES relief. As noted in the original decision denying Moran's IFP motion, the monthly income and expenses he provided in his affidavit indicate that he maintains monthly disposable income of $499.98 (monthly SSI income of $794.00 minus monthly obligations of $294.02). As a result, it appears that Moran can, and therefore must, pay the filing fee for his case to proceed. In addition, to the extent Moran's #8 motion could be construed as seeking the Court's recusal and the reassignment of this case to another U.S. District Judge, such a motion to recuse or reassign is DENIED because Moran has not identified any factual or legal basis upon which a conflict of interest could reasonably exist or be perceived. Mere disagreement with a judge's decision is not a basis for recusal. Finally, the court notes that the plaintiff has sent a series of letters to various staff at the Court. The law requires that any request for relief from the court be made by filing a motion on the docket. Fed. R. Civ. P. 7(b)(1). Sending letters to court staff (or to the judge presiding over the case) does not satisfy this requirement. The Court will take no action on, and will discard, letters sent by the plaintiff to any court staff (or judges). If the plaintiff wishes to seek any relief or court order, he must file a motion. The Clerk is directed to mail a copy of this order and ECF No. 6 to the plaintiff, John Verner Moran, at the address listed on the docket.Signed by Judge Michael P. Shea on 4/14/2021. (Super, John) |

Failure to tender the filing fee within twenty (20) days of the date of this order, i.e., by April 19, 2021, will result in the dismissal of this action.Signed by Judge Michael P. Shea on 3/30/2021.
