Filing 11 ORDER denying #10 Motion for TRO; taking under advisement #10 Motion for Preliminary Injunction. The complaint in this matter is still being reviewed pursuant to 28 U.S.C. Section 1915A and as such, the permissible claims have not been determined and the defendants not identified or served. Further, although Plaintiff purports to seek a Temporary Restraining Order, which would issue on an ex parte basis, he attaches a proposed order to show cause which would suggest he seeks only preliminary injunctive relief and a hearing thereon. In any event, his affidavit does not satisfy the Rule 65 requirements for the issuance of an ex parte restraining order. If it is determined that Plaintiffs claims (all or some) shall proceed to service, the initial review order will also include a directive that the named defendants respond to the request for a preliminary injunction.
