Filing 19 ORDER DENYING MOTION TO PROCEED IN FICTITIOUS NAME (Doc. #12 ). The Court DENIES plaintiff's motion to proceed in a fictitious names for substantially the reasons stated in defendants' objection. The Court has considered all of the required factors, see Sealed Plaintiff v. Sealed Defendant, 537 F.3d 185, 189-90 (2d Cir. 2008). It concludes that the public interest in access to judicial proceedings and fairness to the defendants outweighs the interests asserted by the plaintiff in anonymity, especially in view of the alternatives available to the plaintiff to seek redaction of particular court filings that may reveal details of her medical condition. If plaintiff wishes to proceed with this action, then she shall file an amended complaint that identifies her by her true name on or before May 27, 2021. To the extent that the amended complaint may describe any details or alleged details of plaintiff's medical condition that plaintiff wishes not to be disclosed on the public record, plaintiff may file a motion to seal under D. Conn. L. Civ. R. 5(e) that includes a copy of the full amended complaint to be filed under seal and a redacted amended complaint for filing on the public docket with any sensitive medical information redacted. To the extent that any details of plaintiff's medical condition have already been disclosed in any non-sealed filings on the docket in this case, plaintiff may promptly file a motion to seal any such filings. In addition, any filings by the defendants in this action shall take due care to protect against any unnecessary reference to details of plaintiff's medical condition and, if it is necessary to describe such details in any terms beyond what has already been set forth by the plaintiff in a public filing, shall be filed with a motion to seal and with any such details redacted in public filings. It is so ordered. Signed by Judge Jeffrey A. Meyer on 5/20/2021. (Freberg, B) |
