Filing 19 ORDER. In the #13 Answer to the Complaint, Defendant Steven Mendelson purports to respond to the complaint on behalf of himself and Defendant TRIBL Technology Group, LLC. He offers that he should be able to do so insofar as Plaintiffs seek to pierce the TRIBL Technology Group, LLC corporate veil. However, it is well established that an artificial entity cannot proceed pro se and any person who represents an artificial entity must "be an attorney licensed to practice law before our courts," which, it appears, Defendant Steven Mendelson is not. Jones v. Niagara Frontier Transp. Auth., 722 F.2d 20, 22 (2d Cir. 1983). Accordingly, the Court accepts the appearance of Defendant Steven Mendelson, but Defendant TRIBL Technology Group, LLC remains non-appearing. In light of this order, the Court extends the time for Defendant TRIBL Technology Group, LLC to appear and answer the complaint by 48 days until July 6, 2021. The Court will not take up the #12 Motion for Default prior to July 6, 2021. Signed by Judge Kari A. Dooley on 5/19/2021. (D'Amato, Joseph) |
