June 30, 2021 Opinion or Order Filing 15 ORDER. In his #14 filing, Mr. Jaynes seeks an explanation of the Court's denial of his motion for appointment of counsel. Civil litigants, unlike criminal defendants, do not have a constitutional right to the appointment of counsel. See Leftridge v. Connecticut State Trooper Officer No. 1283, 640 F.3d 62, 68 (2d Cir. 2011) ("A party has no constitutionally guaranteed right to the assistance of counsel in a civil case."). Rather, district judges have "[b]road discretion" as to the appointment of counsel in civil proceedings. Hodge v. Police Officers, 802 F.2d 58, 60 (2d Cir. 1986). However, the Second Circuit has "caution[ed] [district courts] against routine appointment of counsel." Cooper v. A. Sargenti Co., 877 F.2d 170, 174 (2d Cir. 1989). As a threshold matter, the Court evaluates "whether the indigent's position seems likely to be of substance." Hodge, 802 F.2d at 61. Because the Court had insufficient information to make the threshold determination that Mr. Jayne's claims are "likely to be of substance," id., the Court denied Mr. Jayne's motion for appointment of counsel without prejudice to renewal at a later stage in litigation, see also Dietz v. Bouldin, 136 S. Ct. 1885, 1892 (2016) ("[D]istrict courts have the inherent authority to manage their dockets and courtrooms with a view toward the efficient and expedient resolution of cases.").
