Filing 21 ORDER: The "emergency motion for a temporary restraining order and preliminary injunction" (ECF No. 20) is DENIED without prejudice. First, the motion is not supported by any evidence. Although it refers to a "verified complaint," in fact neither the plaintiff's original complaint nor the amended complaint, which supersedes and wholly replaces the original complaint, is verified; nor is there any other evidence supporting the motion. In addition, the motion fails to explain how the plaintiff would be irreparably harmed by the reported consideration for promotion of one or more defendants. Although the plaintiff alleges that the promotions would have the effect of influencing the testimony of one or more individuals, no hearing is scheduled in this lawsuit and any trial is not likely to occur for many months in the future; thus no harm from any testimony is imminent at this stage. And in the meantime, the plaintiff will have the opportunity, through the discovery process, to explore any biases or other matters affecting credibility that may be related to any promotions.
