ORDER DISMISSING COMPLAINT. On July 12, 2021, the Court entered an order to show cause why the complaint should not be dismissed. Doc. #7 . The Court's order explained that the complaint did not name a proper defendant who could be subject to suit in federal court and that it appears a federal court would lack jurisdiction over the types of claims raised by the plaintiff. The Court invited the plaintiff to file a response or an amended complaint that sets forth factual allegations to overcome the Court's stated concerns. The plaintiff has now filed a response bearing a title of "Amended Complaint." Doc. #8 . The response, however, is not in the form of an amended complaint and does not name any proper defendants. In addition, it adds allegations seeking reimbursement of monies paid by the plaintiff to attorneys who represented him in state court. There appears to be no basis for federal jurisdiction over this type of claim. If the plaintiff believes that he has not been treated fairly in the state courts or by his counsel who has represented him in state court, he should seek appropriate relief in the state courts rather than in federal court. Accordingly, the Court DISMISSES this action. The motion for leave to proceed in forma pauperis (Doc. #2 ) is DENIED as moot in light of the dismissal of this action. ORDER TO SHOW CAUSE WHY COMPLAINT SHOULD NOT BE DISMISSED. For the reasons set forth in the attached order, it appears that the complaint is subject to dismissal. Foy may file a response by July 26, 2021 to explain why this action should not be dismissed or to file by that date an amended complaint that sets forth factual allegations that overcome the concerns stated in this ruling.
