Filing 57 ORDER: The Court has reviewed Plaintiff's #52 Motion to Amend the Complaint and the proposed Second Amended Complaint. Although Plaintiff attempts to address the Media Defendants' pending motions to dismiss by providing additional factual detail in support of her defamation and false light claims, the proposed Amended Complaint does not appear to address the other issues raised by the Media Defendants in their motions to dismiss, specifically, whether the defamation claim is untimely under the applicable statute of limitations or whether the Court has subject matter jurisdiction over the claims against the Media Defendants by exercise of its supplemental jurisdiction. Moreover, the proposed Amended Complaint does not address Defendant Michael Dinan's and Defendant The New Canaanite's challenges to the adequacy of the purported service of process. Accordingly, Plaintiff shall show cause by November 18, 2021 as to why the claims against the Media Defendants should not be dismissed for lack of subject matter jurisdiction, alternatively why the defamation claims are not time-barred by the applicable statute of limitations, or alternatively why the claims against Defendant Dinan and Defendant The New Canaanite should not dismissed for insufficient service of process. Signed by Judge Kari A. Dooley on 10/28/2021. (Sweeney, Kevin) |

Counsel is reminded that pursuant to Local Rule 7(b)(3): "All motions for extension of time shall be filed at least three (3) days before the deadline sought to be extended, except in cases in which compelling circumstances warranting an extension arise during the three days before the deadline. Any motion for extension of time filed fewer than three days before the deadline sought to be extended shall, in addition to satisfying all other requirements of this Rule, set forth reasons why the motion was not filed at least three days before the deadline in question." Filing 17 ORDER. The Court has reviewed the Recommended Ruling of Magistrate Judge Merriam concerning #2 Motion for Leave to Proceed In Forma Pauperis as well as the Plaintiff's objection thereto. The Recommended Ruling contains an accurate statement of the applicable law and a thoroughly reasoned analysis and application of that law to the circumstances presented here. The objection is therefore overruled and the Recommended Ruling is Accepted, Adopted and So Ordered except that the Motion to Proceed In Forma Pauperis is denied with prejudice. This matter is held in abeyance until September 10, 2021 by which time Plaintiff must pay the filing fee to the Clerk of the Court. Failure to do so shall result in this matter being dismissed without prejudice on September 13, 2021. Further, the Plaintiff is cautioned that no summonses have issued in this case because the Motion to Proceed In Forma Pauperis remained pending until this Order. Therefore, the Plaintiff's effort at effectuating service, see ECF No. 16, is not authorized by the Court and is ineffective absent a valid summons issued by the Clerk of the Court. See Fed. R. Civ. P. 4(b) and (c). And although counsel has appeared for some defendants, that does not alter the posture of this case as suspended pending the filing of the filing fee. Signed by Judge Kari A. Dooley on 8/11/2021. (D'Amato, Joseph) |

Filing 11 RECOMMENDED RULING. The Court recommends that plaintiff's #2 Motion for Leave to Proceed in forma pauperis be DENIED, without prejudice to re-filing. Plaintiff seeks leave to proceed in this matter without payment of fees and costs, pursuant to 28 U.S.C. 1915, contending that she is unable to pay such fees and costs. See Doc. #2 at 2. However, plaintiff reports that she has approximately $25,000 in cash on hand in savings and checking accounts. See id. at 4. Further, her monthly unemployment benefits of $1,928 more than cover her reported monthly expenses of $1,700. See id. at 3, 4. While she has significant student loan debt, the monthly payments are accounted for in her statement of monthly expenses. See id. at 4. Finally, the Court notes that although plaintiff reports that she has been "unemployed" since March 16, 2021, with her former employer being the Jafri Law Firm, id. at 3, a PACER search suggests that she is actively litigating cases as an attorney with that firm. See, e.g., Schmidt v. Ollie Holdings, LLC, 1:21CV03533(AJN) (S.D.N.Y. Apr. 21, 2021) (complaint signed by plaintiff as counsel at Jafri Law Firm filed April 21, 2021); Harwood v. Town of Rotterdam, et al., 1:21CV00364(DNH) (N.D.N.Y. Mar. 30, 2021) (appearance of plaintiff as counsel at Jafri Law Firm filed June 7, 2021); Welsch v. American Red Cross, 1:20CV09711(PGG) (S.D.N.Y. Nov. 18, 2020) (joint status report signed by plaintiff as counsel at Jafri Law Firm filed May 12, 2021). "Section 1915(a) does not require a litigant to demonstrate absolute destitution[.]" Potnick v. E. State Hosp., 701 F.2d 243, 244 (2d Cir. 1983) (per curiam). However, the Court may properly deny an application where a litigant's "access to [the] court has not been blocked by [her] financial condition[,]" but rather she is "merely in the position of having to weigh the financial constraints posed" by the filing of the complaint against other concerns. Sears, Roebuck & Co. v. Charles W. Sears Real Estate, Inc., 686 F. Supp. 385, 388 (N.D.N.Y. 1988) (citation and quotation marks omitted). "The decision whether to permit a litigant to proceed IFP in a civil case is committed to the sound discretion of the district court." Hill v. Cook, No. 3:21CV00239(SRU), 2021 WL 1178209, at *1 (D. Conn. Mar. 29, 2021). The Court finds that plaintiff's allegations are not sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, the Court recommends that plaintiff's Motion for Leave to Proceed in forma pauperis (Doc. #2 ) be DENIED. If plaintiff wishes to file a renewed Motion for Leave to Proceed in forma pauperis, she may do so on or before August 3, 2021. In the alternative, plaintiff may pay the required filing fee on or before that date. This is a recommended ruling. See Fed. R. Civ. P. 72(b)(1). Any objections to a recommended ruling must be filed with the Clerk of the Court within fourteen (14) days after the filing of the ruling. See Fed. R. Civ. P. 72(b)(2). Accordingly, any objection must be filed on or before August 3, 2021. Failure to file an objection within this time frame will preclude appellate review. See 28 U.S.C. 636(b)(1); Rules 72, 6(a) and 6(d) of the Federal Rules of Civil Procedure; D. Conn. L. Civ. R. 72.2(a); F.D.I.C. v. Hillcrest Assoc., 66 F.3d 566, 569 (2d Cir. 1995); Small v. Secretary of H.H.S., 892 F.2d 15 (2d Cir. 1989) (per curiam). It is so ordered. Signed by Judge Sarah A. L. Merriam on 7/20/2021.(Weis, Anne) |
