Filing 6 ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion seeking to proceed without payment of fees and costs, which motion includes a sworn statement as to plaintiff's current financial circumstances. See Doc. #2 -1. Plaintiff has completed the required information. Plaintiff asserts that she has $16,000 in her checking account, which is "mostly from a payment from SSA." Id. at 4. Plaintiff's counsel further explains this is from a "recently received... lump-sum payment representing past-due Disabled-Adult Child Benefits[]" and "is earmarked for [plaintiff's] current and future living expenses, as well as the two student loans she has been attempting to repay." Doc. #2 at 1. At this time, plaintiff's only resources come from what counsel represents are past-due benefits. Presumably, had those benefits been properly paid, plaintiff would have spent those benefits in due course to cover her monthly obligations. See Doc. #2 -1 at 4-5. Plaintiff also has significant student loan debt, see Doc. #2 at 1, and receives "Husky Insurance[.]" Doc. #2 -1 at 3. At this stage, such allegations are sufficient to establish that plaintiff is unable to pay the ordinary filing fees required by the Court. See 28 U.S.C. 1915(a)(1). Accordingly, plaintiff's #2 Motion for Leave to Proceed in forma pauperis is GRANTED. It is so ordered. Signed by Judge Sarah A. L. Merriam on 7/30/2021. (Katz, S.) |
