September 29, 2021 Opinion or Order Filing 6 ORDER TO SHOW CAUSE. In Defendant's Notice of Removal, ECF No. 1, Defendant alleges that this Court has original jurisdiction over this matter pursuant to 28 U.S.C. s 1332(a), diversity jurisdiction. However, Defendant also acknowledges that its principal place of business is Connecticut, making Defendant a Connecticut citizen for diversity and removal purposes. See 28 U.S.C s 1332(c)(1). And 28 U.S.C. s 1441(b) provides that "A civil action otherwise removable solely on the basis of the jurisdiction under section 1332(a) of this title may not be removed if any of the parties in interest properly joined and served as defendants is a citizen of the State in which such action is brought." This is the so-called forum defendant rule. See Gibbons v. Bristol-Myers Squibb Co., 919 F.3d 699, 705 (2d Cir. 2019). Further, the Defendant acknowledges that it received service of the complaint in this matter on August 29, 2021, rendering the statute applicable. Id. (explaining the forum defendant rule and the ability of even home-state defendants to remove an action on the basis of diversity if the defendant has not yet been served).Accordingly, on or before October 15, 2021, Defendant shall file a brief demonstrating why this case should not be remanded to the Connecticut Superior Court, Judicial District of Hartford. Failure to file a brief may result in remand without further notice from the Court. Plaintiff may respond on or before October 21, 2021. So Ordered. Signed by Judge Kari A. Dooley on 9/29/2021.
