October 29, 2021 Opinion or Order Filing 14 ORDER granting in part and denying in part #9 Motion for Writ of Garnishment, #10 Motion for Writ of Garnishment, and #11 Motion to Expedite. Courts may only provide a prejudgment remedy on an ex parte basis if the a plaintiff files an affidavit setting forth facts sufficient to show both that there is probable cause that a judgment in the amount of the prejudgment remedy sought will be rendered in favor of the plaintiff and that "there is reasonable likelihood that the defendant (1) has hidden or will hide himself so that process cannot be served on him or (2) is about to remove himself or his property from this state or (3) is about to fraudulently dispose of or has fraudulently disposed of any of his property with intent to hinder, delay or defraud his creditors or (4) has fraudulently hidden or withheld money, property or effects which should be liable to the satisfaction of his debts." Conn. Gen. Stat. Section 52-278e. And even when such remedy might be appropriate, the Due Process Clause of the Fourteenth Amendment requires that courts balance, among other things, the plaintiff's need for such remedy with the defendant's right to be heard. See Connecticut v. Doehr, 501 U.S. 1 (1991); see also Shaumyan v. O'Neill, 987 F.2d 122, 126 (2d Cir. 1993) (applying Doehr and upholding a prejudgment remedy).Plaintiffs, though not citing to Section 52-278e, do raise the specter of assets being concealed if the Defendants are provided notice of the prejudgment remedy application. They rely largely on a history of nefarious undertakings by the Defendants as well as somewhat speculative and conclusory allegations of a present risk of assets being hidden or transferred. On this record, the Court cannot conclude that the statutory requirements for providing ex parte relief are met. Indeed, Plaintiffs have requested an attachment be made on real property located at 88 Dingletown Road, Greenwich, Connecticut but have not identified any evidence-based concern that Defendant Estelle Abrams might fraudulently dispose of that property before a judgment could be rendered in this case, or a hearing held on the application for prejudgment remedy. Moreover, the Court has concerns about denying the Defendants' the right to be heard, where, as here, the issue of whether to provide a prejudgment remedy is not one that can or will be decided solely on documentary proof. Cf. Shaumyan, 987 F.2d at 12627 (citing Doehr, 501 U.S. at 14). Plaintiffs' request for ex parte relief is therefore DENIED.However, the Court GRANTS Plaintiffs' motion to the extent it seeks, in the alternative, a hearing on the application. Such hearing is scheduled for November 12, 2021 at 9:30 a.m. A separate order will enter directing Plaintiffs to serve the Defendants with notice of this hearing in accordance with Conn. Gen. Stat.
