Filing 7 ORDER denying #2 Motion for Leave to Proceed in forma pauperis. The petitioner, Michael Inzitari, presently confined at Hartford Correctional Center filed a petition for writ of habeas corpus purportedly pursuant to 28 U.S.C. 2254 to challenge his confinement on several pending criminal charges. He seeks leave to proceed without paying the $5.00 filing fee under 28 U.S.C. 1915. See ECF Nos. 1, 2. The Court considers whether information provided by Inzitari demonstrates that the burden of paying the $5.00 filing fee would hamper his ability to obtain the necessities of life or force him to abandon a potentially meritorious claim. See Adkins v. E.I. Dupont de Nemours & Co., 335 U.S. 331, 339-40 (1948). Inzitari states that in the twelve-month period preceding the filing of this action, he received an Economic Income Payment (IEP) of $2,000.00, he has $1,602.23 in cash or a checking or savings account and $1,300.00 in unspecified debts, and no one is dependent upon him for support. Id. at 2. See ECF No. 2 at 1. His prison trust fund account reflects a balance of $1,646,29 as of October 4, 2021. See ECF No. 3. Inzitari has failed to demonstrate that he would have to forgo lifes necessities if he paid the $5.00 filing fee and the Application to Proceed In Forma Pauperis, [ECF No. 2], is DENIED. All further proceedings in the matter shall be held in abeyance for twenty (20) days pending Inzitaris delivery of the filing fee in the amount of $5.00 (cash, money order, or bank or cashiers check made payable to the Clerk, U.S. District Court) to the Clerks Office, 915 Lafayette Boulevard, Connecticut, 06604.
