Filing 6 ORDER. The #1 Complaint does not state an adequate basis for the Court's subject matter jurisdiction. "If subject matter jurisdiction is lacking and no party has called the matter to the court's attention, the court has the duty to dismiss the action sua sponte." Durant, Nichols, Houston, Hodgson & Cortese-Costa P.C. v. Dupont, 565 F.3d 56, 62 (2d Cir. 2009). The complaint alleges no claims arising under federal law. Thus, this Court has jurisdiction only if the requirements of 28 U.S.C. 1332 are met. That statute provides that "district courts shall have original jurisdiction of all civil actions where the matter in controversy exceeds the sum or value of $75,000, exclusive of interest and costs, and is between... citizens of different States." 28 U.S.C. 1332(a)(1). Here, the plaintiff seeks $119.97 from the defendant, so the amount-in-controversy requirement is not met. The plaintiff is directed to file an amended Complaint that states an adequate basis for this Courts jurisdiction--if such a basis exists--no later than November 18, 2021.
