ORDER granting #3 Motion for Leave to Proceed in forma pauperis. Plaintiff has filed a motion for leave to proceed without payment of fees and costs, which motion includes a declaration under penalty of perjury as to her current financial circumstances. See ECF No. 3. Her declaration states that she is unemployed, as has been for about eleven years. She states that she owns on assets other than a thirteen-year-old car, and has no cash on hand. While her affidavit reports that her spouse has income, that income barely exceeds the federal poverty level for a family of four. See 86 Fed. Reg. 7732-7734 (stating that federal poverty level for a family of four in Connecticut is $26,500); see also Zavala v. Cornell Univ., No. 5:11-cv-1403 (LEK/DEP), 2011 WL 13353099, at *1-2 (N.D.N.Y. Dec. 13, 2011) (considering relationship of plaintiff's income to federal poverty guidelines in deciding whether to grant IFP status). At this stage, the statements in the plaintiff's affidavit are sufficient to establish that she is unable to pay the filing fees ordinarily required by the Court. See 28 U.S.C. 1915(a)(1).
