Filing 8 ORDER adopting #7 Recommended Ruling. The Court has reviewed the Recommended Ruling concerning #1 the Complaint and #2 motion to proceed in forma pauperis. Plaintiff did not file an objection to the Recommended Ruling by January 5, 2022, nor did the Plaintiff file an amended financial affidavit or an amended complaint by January 17, 2022. See Fed. R. Civ. P. 72(b)(2). The Recommended Ruling contains an accurate statement of the applicable law and a thoroughly reasoned analysis and application of that law to the circumstances presented here. The Recommended Ruling therefore is Accepted, Adopted and So Ordered. Notwithstanding, the Court further observes that even if the complaint might be liberally construed to allege an injury in fact for purposes of the Plaintiff Organizations standing to assert, inter alia, First and Fourth Amendment claims, Plaintiff A. Bey cannot represent the organization (or any other named Plaintiff) insofar as he is not a member of this Courts bar and these claims brought ostensibly on behalf of the Plaintiff Organizations would be dismissed without prejudice on this basis as well. Filing 7 RECOMMENDED RULING: As set forth in the attached Recommended Ruling, the Court respectfully recommends that the plaintiffs' Motion for Leave to Proceed In Forma Pauperis be DENIED, without prejudice to refiling. The plaintiffs have left large sections of the financial affidavit blank, thereby preventing the Court from having an adequate understanding of the plaintiffs' financial situations. With respect to the plaintiffs' Complaint, the Court respectfully recommends that the plaintiffs' claims against: (1) the State of Connecticut and the East Hartford Police Department be DISMISSED with prejudice; (2) Defendants Sansom, Guilfuchi, and Town of East Hartford be DISMISSED without prejudice; (3) Defendants Medina, Flores, Cortez, and Broun for assault and battery, "fingerprinting," "questioning," identifying him as "Greg Mack" in the East Hartford police system, and First Amendment violations be DISMISSED with prejudice; and (4) Defendants Medina, Flores, Cortez, and Broun for violations of the Fourth Amendment violations be DISMISSED without prejudice.If the plaintiffs wish to pursue their claims that are subject to dismissal without prejudice, they must file an amended complaint that sets forth a clear statement of their claims together with an explanation of the basis for these claims, on or before January 17, 2022. Any amended complaint must comply with the Federal and Local Rules of Civil Procedure. The amended complaint must be captioned "Amended Complaint," and will completely supersede the current Complaint. 16 Pages. Objections due by 1/17/2022. Signed by Judge Robert M.
