ORDER: Re #13 Emergency Motion to Transfer: Rule 45(f) provides "[wh]en the court where compliance is required did not issue the subpoena, it may transfer a motion under this rule to the issuing court if the person subject to the subpoena consents or if the court finds exceptional circumstances." The Notes of the Advisory Committee to the 2013 amendments further provide that "[i]n some circumstances, however, transfer may be warranted in order to avoid disrupting the issuing courts management of the underlying litigation, as when that court has already ruled on issues presented by the motion or the same issues are likely to arise in discovery in many districts." I find that exceptional circumstances support transfer in this case. The issuing court has extensive familiarity with this complex case which has been pending for over two years and determining the merits of the motion would require knowledge of the multiple discovery motions that the issuing court has carefully considered and ruled upon. Moreover, Booking Holdings, Inc. has not established that it would suffer an undue burden were the motion to be granted. Accordingly, the motion to transfer is GRANTED. Signed by Judge Stefan R.
