April 27, 2021 Opinion or Order Filing 10 ORDER OF DETENTION. The Court conducted a hearing today, at which Jacob Mazeika appeared with counsel. Mr. Mazeika consented to detention, without prejudice, and elected not to present any proposal for release. "There is a strong, and longstanding, presumption against bail in international extradition proceedings." Matter of Extradition of Rovelli, 977 F. Supp. 566, 567 (D. Conn. 1997). That presumption "counsels against incurring even a small risk absent special circumstances." Borodin v. Ashcroft, 136 F. Supp. 2d 125, 134 (E.D.N.Y. 2001). The presumption against release places the burden on Mr. Mazeika to make a showing of special circumstances. He has not made such a showing. Accordingly, the Court orders him detained, pending the extradition hearing. The defendant is remanded to the custody of the Attorney General or to the Attorney General's designated representative for confinement in a corrections facility separate, to the extent practicable, from persons awaiting or serving sentences or being held in custody pending appeal. The defendant must be afforded a reasonable opportunity for private consultation with counsel. On order of a court of the United States or on request of an attorney for the Government, the person in charge of the corrections facility must deliver the defendant to a United States Marshal for the purpose of an appearance in connection with a court proceeding.
