Filing 7 INITIAL REVIEW ORDER. For the reasons set forth in the attached order, the claims against Commissioner Quiros and Warden Barone are SEVERED and DISMISSED without prejudice to Plaintiff asserting them in a separate action. The ADA claim is DISMISSED without prejudice under 28 U.S.C. 1915A(b). All Eighth Amendment claims against Defendants Santiago, Sharp, Molden, Bowles, and Cook are DISMISSED without prejudice under 28 U.S.C. 1915A(b)(1). The Court declines to exercise supplemental jurisdiction over Mr. Goodes state law claims. The case will PROCEED on the Eighth Amendment claims for use of excessive force and unconstitutional conditions of confinement against Defendants Josefiack, Blackstop, Anderson, and Melendez in their individual capacities only. Mr. Goode's Motion for Order to Execute Service of Complaint is DENIED. Because Mr. Goode has paid the filing fee in this case, and he has not been granted in forma pauperis status, he is responsible for serving the Complaint on Defendants in their individual capacities within ninety (90) days of the date of this Order.
