Filing 17 SCHEDULING ORDER. The Court adopts the following pre-trial schedule:- Plaintiff shall file motions to join additional parties by February 25, 2022.- Plaintiff shall file motions to amend the pleadings by February 25, 2022.- Initial disclosures shall be due by March 8, 2022.- Defendant shall file motions to join additional parties by March 25, 2022.- Defendant shall respond to any amended complaint by March 25, 2022.- Plaintiff shall designate all trial experts and provide opposing counsel with reports from retained experts pursuant to Fed. R. Civ. P. 26(a)(2) on any issues on which Plaintiff bears the burden of proof by July 15, 2022.- Defendant shall designate all trial experts and provide opposing counsel with reports from retained experts pursuant to Fed. R. Civ. P. 26(a)(2) by September 2, 2022. - Depositions shall be completed by December 2, 2022.- All discovery shall be completed by December 2, 2022.- If, after the close of discovery, the parties wish to meet with a Magistrate Judge to discuss settlement, the parties may jointly file such a request by December 9, 2022. - Summary judgment motions shall be filed by February 10, 2023. - Any party with a claim or counterclaim for damages shall provide a damage analysis by February 17, 2023. - The Joint Trial Memorandum shall be due by March 3, 2023 or, if dispositive motions are filed, thirty (30) days after the Courts ruling on those motions. - Trial ready date will be April 7, 2023 or thirty (30) days after the filing of the parties joint trial memorandum, whichever is later. Filing 15 ORDER granting #12 Motion to Sever and Remand. As the parties note in their joint motion to sever and remand Count Three of the Complaint, see ECF No. 12 (Jan. 14, 2022), remand of Count Three is mandated under 28 U.S.C. 1445(c). See 28 U.S.C. 1445(c) ("A civil action in any State court arising under the workmen's compensation laws of such State may not be removed to any district court of the United States."). Remand is also mandated under 28 U.S.C. 1441(c). See 28 U.S.C. 1441(c)(2) (noting that any action which includes both a federal claim and a "claim that has been made nonremovable by statute... may be removed if the action would be removable without the inclusion of the" nonremovable claim, and in that situation, "the district court shall sever from the action all [nonremovable] claims" and "shall remand the severed claims to the State court from which the action was removed"); see also Pomales v. Lowe's Home Ctrs., LLC, No. 3:19-cv-831 (JBA), 2019 WL 6271252, at *6 (D. Conn. Nov. 25, 2019) (removing and severing Count One of a Complaint, arising under Connecticut General Statutes 31-290, under 28 U.S.C. 1445(c)); Miley v. Housing Auth. of Bridgeport, 926 F. Supp. 2d 420, 428 (D. Conn. 2013) (holding that where "a civil action contains both federal claims and non-removable claims" under 1445(c), 1441(c) "unambiguously directs the Court in such a scenario to sever from the action the non-removable claim and remand that claim back to state court"). Accordingly, the Clerk of Court is respectfully directed to sever Count Three of the Complaint and remand that cause of action to the Connecticut Superior Court, Judicial District of Hartford.Signed by Judge Victor A.
