March 1, 2022 Opinion or Order Filing 38 ORDER granting, absent objection, #37 Motion for Leave to File an Amended Complaint Seeking the Joinder of Additional Plaintiffs. The Court notes that the motion does not comply with Local Rule 7(f). Local Rule 7(f) provides, in part: "Any motion to amend a party's pleading under Fed. R. Civ. P. 15(a) that requires leave of court shall... in cases in which the movant is represented by counsel, be accompanied by both a redlined version of the proposed amended pleading showing the changes proposed against the current pleading and a clean version of the proposed amended pleading." D. Conn. L. Civ. R. 7(f). No redlined version is attached to the motion. The Court previously advised plaintiffs that any motion to amend must be "in full compliance with the Federal and Local Rules[.]" Doc. #31, #36. The Court will not deny the motion on this basis, simply in the interest of efficiency. But the Court reminds counsel that compliance with the Federal and Local Rules is required. Motions that do not comply fully with the applicable Rules may be summarily denied. Counsel have now had ample opportunity to familiarize themselves with the Rules, and will be required to comply with them. Plaintiff shall file the Amended Complaint (Doc. #37 -1) on the docket as a separate docket entry forthwith. February 18, 2022 Opinion or Order Filing 31 ORDER denying, without prejudice, #26 Motion for Leave to Amend the Complaint. Plaintiff seeks to amend the complaint in this matter to add additional plaintiffs. (The caption of the proposed Amended Complaint is difficult to discern, but appears to add either two or three additional plaintiffs.) However, as the Court previously alerted all parties, "the proposed Amended Complaint makes no allegations regarding, or indeed mention of, the putative additional plaintiffs." Doc. #27. The Joint Notice filed by the parties does not address this deficiency. See Doc. #29 . There are no substantive allegations made by the added plaintiffs in the body of the proposed amended complaint. Accordingly, addition of these plaintiffs would be futile. See Milanese v. Rust-Oleum Corp., 244 F.3d 104, 110 (2d Cir. 2001) (noting that leave to amend may be denied as futile "if the proposed new claim cannot withstand a 12(b)(6) motion to dismiss for failure to state a claim"). The Court will provide plaintiff one final opportunity to file a Motion to Amend the Complaint, in full compliance with the Federal and Local Rules, no later than March 4, 2022. The Proposed Amended Complaint attached to any such motion must include clear factual allegations and demands for relief as to any plaintiff and any defendant named. January 26, 2022 Opinion or Order Filing 14 ORDER. The Court issued an Order to Show Cause why this matter should not be summarily remanded to the Superior Court. See Doc. #11. Defendants responded by asserting that "Glenstone qualifies as an improper, nominal defendant for purposes of the diversity determination, subject to dismissal under F.R.C.P. 21." Doc. #12 at 5. However, Glenstone has not moved for dismissal, or for severance under Rule 21. Indeed, a related PJR action was pending in Superior Court for approximately five months, and it does not appear that Glenstone ever moved to dismiss in Superior Court for any reason.Defendants further argue that "[p]laintiff has not alleged any claims for relief and does not seek any relief from" Glenstone. Id. The plain language of the Amended Complaint indicates that plaintiff brings his claims against Glenstone, and seeks relief from Glenstone along with the other defendants. See Doc. #1 -2. "[D]iversity jurisdiction is generally determined from the face of the complaint." Sea Green Holdings, LLC v. Angera, No. 3:18CV00264(MPS), 2018 WL 1737643, at *2 n.2 (D. Conn. Apr. 11, 2018). Finally, defendants contend that the doctrine of res judicata bars any claims against Glenstone, based on a stipulation entered into between plaintiff and Glenstone in June 2021, and the resulting withdrawal of a prior case. See id. at 10; Doc. #12 -3 at 1. (The Court sets aside, for now, the question of whether this stipulation would in fact have res judicata effect as to the claims arising prior to June 2021.) The stipulation does not expressly release any and all claims against Glenstone existing as of June 2021. Furthermore, it does not purport to release any future claims plaintiff may have against Glenstone. The Amended Complaint in this matter was filed in December 2021, and alleges that plaintiff continues to reside in the apartment that gives rise to the claims at issue. It is entirely possible therefore that the Amended Complaint asserts claims arising out of events occurring before and/or after June 2021. "It is well-settled that the party asserting federal jurisdiction bears the burden of establishing jurisdiction, and it must prove jurisdiction by a preponderance of evidence." Platinum-Montaur Life Scis., LLC v. Navidea Biopharmaceuticals, Inc., 943 F.3d 613, 617 (2d Cir. 2019) (citation and quotation marks omitted). "In light of the congressional intent to restrict federal court jurisdiction, as well as the importance of preserving the independence of state governments, federal courts construe the removal statute narrowly, resolving any doubts against removability." Id. (citation and quotation marks omitted). Defendants have not, as of this writing, met their burden. The Court will schedule a hearing on the question of subject matter jurisdiction in this matter for February 4, 2022. A separate calendar will enter. Counsel for all parties shall be prepared to address the question of subject matter jurisdiction in this hearing. Plaintiff shall file a memorandum on the docket on or before February 2, 2022, setting forth plaintiff's position regarding the issues raised in this Order, the Order to Show Cause (Doc. #11), and defendant's response thereto (Doc. #12 ). January 14, 2022 Opinion or Order Filing 11 ORDER TO SHOW CAUSE. Defendants have filed the statement required by the Standing Order on Removed Cases. See Doc. #10 . That statement asserts: "Defendant, GLENSTONE MANAGEMENT LLC is a citizen of the State of Connecticut, the remaining defendants are citizens of the State of Florida." Doc. #10 at 1. The Notice of Removal states that plaintiff is a citizen of Connecticut, and that defendant Select Property (US) is a citizen of Florida; it makes no representations regarding the citizenship of defendant Glenstone Management LLC. See Doc. #1 at 3. In all matters, whether removed or not, federal courts "have an independent obligation to determine whether subject-matter jurisdiction exists, even in the absence of a challenge from any party." Arbaugh v. Y&H Corp., 546 U.S. 500, 514 (2006). "If the court determines at any time it lacks subject-matter jurisdiction, the court must dismiss the action." Fed. R. Civ. P. 12(h)(3). Defendant, as the removing party, bears the burden of establishing subject matter jurisdiction. See Curcio v. Hartford Fin. Servs. Grp., 469 F. Supp. 2d 18, 21 (D. Conn. 2007). "[F]ederal courts construe the removal statute narrowly, resolving any doubts against removability." Purdue Pharma L.P. v. Kentucky, 704 F.3d 208, 213 (2d Cir. 2013) (citations and quotation marks omitted).The asserted basis for removal to federal court is "diversity of citizenship." Doc. #1 at 3. Diversity jurisdiction under 28 U.S.C. 1332 requires complete diversity. "Complete diversity requires that all plaintiffs be citizens of states diverse from those of all defendants." Van Buskirk v. United Grp. of Companies, Inc., 935 F.3d 49, 53 (2d Cir. 2019) (citation and quotation marks omitted). It appears that plaintiff and one defendant are citizens of the same state (Connecticut), thus destroying diversity jurisdiction. Furthermore, the removal statute provides: "A civil action otherwise removable solely on the basis of the jurisdiction under section 1332(a) of this title may not be removed if any of the parties in interest properly joined and served as defendants is a citizen of the State in which such action is brought." 28 U.S.C. 1441(b)(2). Glenstone Management LLC is a defendant who is a citizen of Connecticut, which is the state in which this action was originally brought. It therefore appears that this matter was not properly removed to the District Court, and that this Court lacks subject matter jurisdiction.
