ORDER : The Plaintiffs' motion #14 is granted in part and denied in part. The Plaintiffs' request for expedited discovery is granted for good cause because the identified Defendants have not appeared and because identification of the John Doe Defendants is necessary to move the litigation forward. The Defendants are ordered to produce the information requested in plaintiffs' Exhibit A [14-3] within 30 days of service of this order on the identified Defendants. Because the motion was filed ex parte, Defendants may file a motion to dissolve this order within the same timeframe. The Plaintiffs shall serve a copy of this order and their motion #14 on the identified Defendants and shall file proof of such service on the docket within 7 days of this order. The Plaintiffs' request for an order requiring Defendants to preserve documents and evidence is denied. "The obligation to preserve evidence arises when the party has notice that the evidence is relevant to litigation or when a party should have known that the evidence may be relevant to future litigation." Fujitsu Ltd. v. Fed. Express Corp., 247 F.3d 423, 436 (2d Cir. 2001).
