Filing 6 RECOMMENDED RULING: For the reasons stated above, the Court recommends that the plaintiffs Motion to Proceed in Forma Pauperis (Doc. No. #2 ) be DENIED without prejudice to re-file an amended financial affidavit. If the plaintiff wishes to pursue this action, then he must either pay the required filing fee or submit a new motion that meets all the requirements of 28 U.S.C. 1915, including a financial affidavit in which he details his income and itemizes his monthly expenses, by April 17, 2022. Next, the Court recommends that the claims against both defendants in their official capacities be DISMISSED with prejudice pursuant to 28 U.S.C. 1915(e)(2)(B)(i) and (ii). Finally, the Court recommends that the claims against both defendants in their individual capacities be DISMISSED without prejudice to re-file. If the plaintiff wishes to pursue his claims that are subject to dismissal without prejudice, then he must file an amended complaint that sets forth a clear statement of his claim against each defendant, together with an explanation of the basis for each claim, by April 17, 2022. Any amended complaint must comply with the Federal and Local Rules of Civil Procedure. The amended complaint must be captioned Amended Complaint and will completely supersede the current Complaint. 10 Pages. Objections due by 04/17/2022 Signed by Judge Robert M.
