Filing 13 NOTICE to the Court by Kyle L. Paschal-Barros (Oliver, T.) Modified on 5/5/2022 (Oliver, T.). |
Filing 12 ORDER denying #10 Motion for Reconsideration. Federal courts generally do not reconsider their prior orders unless there has been an intervening change of controlling law, new evidence has become available, or there is a need to correct a clear error or prevent manifest injustice. See, e.g., Virgin Atl. Airways, Ltd. v. Nat'l Mediation Bd., 956 F.2d 1245, 1255 (2d Cir. 1992). In this case, there has been no change in the relevant law, no new evidence has been presented, and there is no error or injustice to correct. While the Court will not reconsider its order directing the plaintiff to file another trust account statement, it will clarify the order for his benefit. The Court did not order the plaintiff to re-file because his document is not a six-month document; rather, the Court ordered him to re-file because the document he filed was a partial, incomplete copy. A complete inmate trust account statement is a multi-page document that lists not only the inmate's debts and obligations, but also all transactions in and out of his account over the preceding six months. In this case, the plaintiff filed only the first page listing his debts and obligations. He did not include the remaining pages listing his account transactions. The plaintiff is again ordered to file a certified copy of a complete inmate trust account statement for the period September 2, 2021 - March 2, 2022. The Court will extend by two weeks - that is, until May 4, 2022 - his time period for doing so. The plaintiff is respectfully reminded that the Court sees dozens if not hundreds of CT DOC inmate trust account statements each year, and it knows the difference between a complete copy and an incomplete copy. Failure to file a complete, certified copy by May 4, 2022 may result in dismissal of the case. It is so ordered. Signed by Judge Thomas O. Farrish on 04/20/2022. (Farrish, Thomas) |
