April 14, 2022 Opinion or Order Filing 25 ORDER TO SHOW CAUSE: Within 7 days of this order, the Defendants shall show cause why the Court should not remand the case to state court in light of the considerations courts consider under 28 U.S.C. Sec. 1367(c)(3) (some of which are discussed in plaintiff's motion to remand (ECF No. #24 )), plaintiff's withdrawal of the federal claim, and plaintiff's representations about the timing of her move and her residency allegations in the original complaint, which appear to defeat diversity jurisdiction. April 6, 2022 Opinion or Order Filing 22 ORDER. Plaintiff has failed to list defendants, other than Primed, LLC, in the Amended Complaint's caption. ECF No. 19. Rule 10 of the Federal Rules of Civil Procedure requires that the "title of the complaint name all the parties." Fed. R. Civ. P. 10(a). Thus, if the plaintiff wishes to sue the additional defendants, she must file a Second Amended Complaint with all defendants listed in the caption (without using "et al.") by April 12, 2022. The Second Amended Complaint shall otherwise be identical to the Amended Complaint already filed. If the plaintiff fails to file a Second Amended Complaint as described in this order by April 12, the Court will treat the Amended Complaint as the operative complaint and will therefore treat Primed, LLC as the only defendant in this matter, dismissing all claims against previously identified defendants. Signed by Judge Michael P. Shea on 4/6/2022. (Wong, Qing Wai)
