ORDER denying ECF No. #2 , Motion for Leave to Proceed In Forma Pauperis. "It is well settled that the decision to proceed in forma pauperis in civil cases is committed to the sound discretion of the district court." Hinton v. Pearson, No. 3:21-CV-863 (MPS), 2021 WL 3036921, at *1 (D. Conn. July 19, 2021). Although a litigant applying to proceed in forma pauperis is not required to show that paying the attendant fees of litigation would leave them absolutely destitute, see Potnick v. E. State Hosp., 701 F.2d 243, 244 (2d Cir. 1983), the litigant "does need to show that 'paying such fees would constitute a serious hardship.'" Sarah W. v. Kijakazi, No. 3:21-CV-01726-SRU, 2021 WL 6551097, at *1 (D. Conn. Dec. 29, 2021) (quoting Fiebelkorn v. U.S., 77 Fed. Cl. 59, 62 (2007)). Upon review of Plaintiff's financial affidavit, which reflects that Plaintiff has $67,000 in cash and nearly half a million dollars in investment funds, the court cannot conclude that paying his court fees would constitute a hardship for Plaintiff. Accordingly, the Motion to Proceed In Forma Pauperis is DENIED. Plaintiff is instructed to remit the filing fee on or before May 16, 2022.
