Filing 13 GENERAL SCHEDULING ORDER. The court thanks the parties for submitting their Rule 26(f) Planning Report, see ECF No. #12 , and hereby APPROVES and ADOPTS all deadlines and procedures proposed therein. All discovery shall be completed on or before March 31, 2023, and all interim discovery deadlines are hereby incorporated by reference. Any motions for summary judgment shall be filed on or before May 31, 2023. The parties' joint trial memorandum shall be filed on or before July 31, 2023, or within 60 days of the court's ruling on dispositive motions, whichever date is later. The court will thereafter set a jury selection date, and the parties should be prepared to proceed to trial on September 30, 2023. In their report, the parties ask the court to issue an order pertaining to the inadvertent disclosure of privileged material. The court appreciates the genuine, intensive, and good-faith effort from the parties in ensuring a fair and efficient exchange of discoverable materials. Your collaboration and professionalism are evident. Still, the court declines to issue the requested 502(d) order. Federal Rule of Evidence 502 offers protections sufficient to address concerns regarding the inadvertent disclosure of privileged material while also allowing a reviewing court to consider the reasonableness of the disclosing party's actions. Given the detailed work articulated in the 26(f) report, the court is assured that the parties will carry out their individual and ethical obligations; additionally, the court reserves its ability to address any specific discovery disputes that might arise, through careful consideration of any facts pertinent thereto. Accordingly, the request that the court issue an order pursuant to Fed. R. Evid. 502 respectfully is denied. Signed by Judge Omar A. Williams on 6/9/22. (Wagner, Rebecca) |
