Filing 34 ORDER granting #20 Motion to Dismiss. For reasons explained in the attached Ruling and Order, the Respondent's Motion to Dismiss, ECF No. #20 , is GRANTED. The petition is DISMISSED without prejudice for failure to exhaust state court remedies on all claims before commencing this action. The Court concludes that jurists of reason would not find it debatable that Mr. Baltas failed to exhaust his state court remedies on all grounds asserted in this Petition. Thus, a certificate of appealability will not issue. See Slack v. McDaniel, 529 U.S. 473, 484 (2000) (holding that when a district court denies a habeas petition on procedural grounds, a certificate of appealability should issue if jurists of reason would find debatable the correctness of the district courts decision). Mr. Baltas is informed that, if he wishes to proceed only on the grounds for which he has exhausted his state court remedies, he may file an amended petition containing only the exhausted claims. He should do so by January 27, 2023. Mr. Baltas is cautioned, however, that if he chooses to proceed only on the exhausted claims, he will run the risk that any subsequent petition containing the unexhausted claims will not be considered by this Court as it would constitute a second or successive petition.
