The caller indicated that the United States Attorney's Office may file a request for a status conference in this matter to discuss the issues of the named defendants in this action and service of the complaint/amended complaint and summons on appropriate parties. The caller asserted that the appropriate defendant in this action is the United States of America, not the relevant federal agency, but the complaint must still be served on the relevant federal agency. The Court notes that no counsel from the United States Attorney's Office has entered an appearance in this matter to date. To the extent that a status conference or other relief from the Court is necessary to cure any deficiencies with items on the docket, the Court will entertain any motions filed by counsel for a party. ORDER finding as moot #13 Motion to Amend Complaint. Pursuant to Federal Rule of Civil Procedure 15(a)(1)(B), if a pleading "is one to which a responsive pleading is required," a party may amend the pleading once as a matter of course, "within... 21 days after service of a responsive pleading or 21 days after service of a motion under Rule 12(b), (e), or (f), whichever is earlier." Because no responsive pleading or motion pursuant to Rule 12(b), (e), or (f) has been filed with respect to Plaintiff's complaint, Plaintiff may amend his complaint once as a matter of course without the Court's leave. Accordingly, because Plaintiff's motion is unnecessary, it is denied as moot. The Clerk is directed to docket the proposed amended complaint at ECF No. 13-1 as Plaintiff's amended complaint. ORDER. On May 26, 2022, an electronic summons was issued to the United States Bureau of Prisons ("BOP"). ECF No. #11 . However, the BOP is not named as a defendant in Plaintiff's complaint. See ECF No. #1 . Accordingly, the Court has determined that the electronic summons was improperly issued to the BOP. If Plaintiff wishes to name the BOP in this action, he must amend his complaint to do so pursuant to Federal Rule of Civil Procedure 15.
