May 27, 2022 Opinion or Order Filing 11 ORDER denying without prejudice #10 Motion for Extension of Time. Defendant Daniel Karp has not filed an appearance pursuant to Local Rule 5(b), a prerequisite to seeking relief in the form of a motion. Counsel and parties are reminded that pursuant to Local Rule 7(b)(2): "All motions for extensions of time shall include a statement of the movant that (1) the movant has inquired of all non-moving parties and there is agreement or objection to the motion, or that (2) despite diligent effort, including making the inquiry in sufficient time to afford non-movant a reasonable opportunity to respond, the movant cannot ascertain the position(s) of the non-movant(s)." Future failures to comply with Local Rule 7(b)(2) may result in the denial of non-compliant motions for extension of time without prejudice to refiling of a compliant motion. Moreover, the Court construes Defendant Daniel Karp's #10 motion to improperly seek relief on behalf of all Defendants. Defendant Daniel Karp does not have legal standing to seek relief on behalf of anyone other than himself. Am. Psychiatric Ass'n v. Anthem Health Plans, Inc., 821 F.3d 352, 358 (2d Cir. 2016) ("a [party] may ordinarily assert only [his] own legal rights, not those of third parties"). The rule against third-party standing is not absolute, but the #10 motion does not provide any basis for finding third-party standing. See generally Camacho v. Brandon, 317 F.3d 153, 159 (2d Cir. 2003) (setting forth legal standard for third-party standing). Nor is Defendant Daniel Karp, who is not an attorney, permitted to appear on behalf of Defendant Suzanne Karp or Defendant Care at Home, LLC. Under 28 U.S.C. 1654, "parties may plead and conduct their own cases personally or by counsel." And it is well established that an artificial entity cannot proceed pro se and any person who represents an artificial entity must "be an attorney licensed to practice law before our courts." Jones v. Niagara Frontier Transp. Auth., 722 F.2d 20, 22 (2d Cir. 1983). Notwithstanding, based on the representations made in the motion, the Court sua sponte extends the answer deadline for all Defendants to June 10, 2022. Signed by Judge Kari A. Dooley on 5/27/2022.
