Date Filed Document Text
June 1, 2022 Opinion or Order Filing 5 ORDER: Gramegna has filed a petition for writ of habeas corpus, certiorari, and mandamus. Pursuant to Fed. R. Evid. 201(b), I take judicial notice of the fact that Gramegna is an unsentenced detainee confined within the Connecticut Department of Correction. See Fed. R. Evid. 201(b)(2) (explaining that a "court may judicially notice a fact that is not subject to reasonable dispute because it... can be accurately and readily determined from sources whose accuracy cannot reasonably be questioned"); Inmate Information, CONN. ST. DEPT OF CORR., http://www.ctinmateinfo.state.ct.us/detailsupv.asp?id_inmt_num=248601 (last visited June 1, 2022). A state pretrial detainee may challenge his state detention through a writ of habeas corpus under 28 U.S.C 2241. See Clemente v. Connecticut, 2022 WL 527757, at *1 (D. Conn. Jan. 27, 2022) (state pre-trial detainee should seek relief under section 2241 rather than section 2254). Local court rules require that habeas petitions be filed on court-approved forms. See D. Conn. L. Civ. R. 8(b) (petitions "shall be on forms approved by the Court and supplied by the Clerk").Accordingly, the Clerk is instructed to send Gramegna a copy of the District Court's form for petitions for relief under 28 U.S.C. 2241 and a copy of this order. After Gramegna returns the completed form, I will determine whether an order to show cause should issue in this case. Signed by Judge Stefan R. Underhill on 6/1/2022. (Guerrier, C.)
