November 30, 2022 Opinion or Order Filing 56 ORDER. The Court heard oral argument yesterday on Defendants' motion to dismiss (ECF No. #25 ) and, after carefully considering the oral arguments and the written submissions of the parties, hereby DENIES the motion without prejudice. By separate ruling today, the Court is GRANTING the plaintiffs' motion to stay pending inter partes review ("IPR") requests made by the plaintiffs to the Patent Trial and Appeals Board ("PTAB"). Because those requests may result in the institution of IPR proceedings before the PTAB -- and we will know soon if that is the case -- and because such proceedings could result in a determination of invalidity of one or more of the patents in suit, it would spare judicial resources to await the outcome of the PTAB's decisions on whether to institute the IPRs -- and if instituted, to await the outcome of the IPRs -- before devoting further time to deciding the motion to dismiss, which would be rendered moot if the PTAB finds the patents to be invalid. In addition, allowing the passage of a few more months may make clearer whether the defendants intend to bring further patent infringement actions against any more of the "non-contacted parties" -- in addition to the one they recently filed in the Western District of Texas. While the filing of further actions may not be relevant to the disposition of the motion to dismiss, it may shed further light on the best path forward -- from the standpoint of judicial economy -- in the wake of any ruling granting the motion to dismiss. Under these circumstances, the Court finds that the most sensible step at this juncture is to deny the motion to dismiss without prejudice and allow the defendants to refile it after the PTAB renders its final decision on institution in February 2023 or, if review is granted, after the PTAB renders decisions on the merits of the review(s).
