July 1, 2022 Opinion or Order Filing 12 ORDER granting #10 Motion to Seal Exhibits D and E to Plaintiff's Complaint. Portions of Exhibits D and E to plaintiff's Complaint divulge the parties' confidential pre-suit settlement discussions. The Court finds clear and compelling reasons to seal those portions of Exhibits D and E because "the presumption of access to settlement negotiations[]... is negligible to nonexistent." United States v. Glens Falls Newspapers, Inc., 160 F.3d 853, 858 (2d Cir. 1998). Plaintiff's counsel has now filed versions of Exhibits D and E that redact the settlement-related information. See Docs. #10 -1, #10 -2. Accordingly, the sealing is narrowly tailored to serve the purpose of sealing. See D. Conn. L. Civ. R. 5(e)(3) ("Any such order sealing a judicial document shall include particularized findings demonstrating that sealing is supported by clear and compelling reasons and is narrowly tailored to serve those reasons."). The Clerk of the Court shall seal Exhibit D (Doc. #1 -5) and Exhibit E (Doc. #1 -6) forthwith. In the future, plaintiff's counsel must exercise greater caution before filing documents on the public docket "because the proverbial bell cannot be un-rung once information has already been publicly disclosed."
