SCHEDULING ORDER: The Court adopts the following schedule for pre-trial deadlines based on the parties' Rule 26(f) Report, the Court's preferences with respect to scheduling, and the Court's current calendar. The Court notes the parties' request for a scheduling conference after the Court rules on Defendant's pending motion to dismiss. Because of uncertainty regarding when the Court will rule on the motion, the Court adopts the following schedule now and will address any additional scheduling issues after the ruling.- Initial disclosures are due by September 16, 2022.- Joinder of parties is due by November 11, 2022 (Plaintiff). - Joinder of parties is due by December 9, 2022 (Defendant). - Defendant's response to the Complaint, if necessary, is due 30 days after the Court rules on the pending motion to dismiss. - Depositions of fact witnesses shall be completed by April 14, 2023. - Designation of expert witnesses is due by May 19, 2023 (Plaintiff). - Depositions of expert witnesses shall be completed by July 21, 2023 (Plaintiff). - Designation of expert witnesses is due by August 4, 2023 (Defendant). - Depositions of expert witnesses shall be completed by October 6, 2023 (Defendant).- Designation of rebuttal expert witnesses, if any, is due by October 13, 2023 (Plaintiff).- Depositions of rebuttal expert witnesses shall be completed by December 1, 2023 (Plaintiff).- Damages analysis is due by December 8, 2023.- All discovery shall close by December 15, 2023.- If, after the close of discovery, the parties wish to meet with a Magistrate Judge to discuss settlement, the parties may jointly file such a request by December 22, 2023.- Dispositive motions are due by January 19, 2024.- Joint trial memorandum is due by April 19, 2024, or 30 days after the Court rules on any dispositive motion.- Trial ready date is June 3, 2024, or 30 days after the filing of the joint trial memorandum.Signed by Judge Victor A.
