Filing 8 ORDER denying #2 Motion for Leave to Proceed in forma pauperis. The plaintiff, David Retamar, who is incarcerated at MacDougall-Walker Correctional Institution, has sued employees of the State of Connecticut Department of Correction under 42 U.S.C. 1983 and seeks leave to proceed without paying the filing fee under 28 U.S.C. 1915. The Court considers whether information provided by Mr. Retamar demonstrates that the burden of paying the fees for filing and service would hamper his ability to obtain the necessities of life or force him to abandon a potentially meritorious claim. Adkins v. E.I. DuPont de Nemours & Co., 335 U.S. 331, 339-40 (1948). Mr. Retamar's inmate account balance was $919.20 as of July 1, 2022; he had a six-month average balance of $500.00; and he has no dependents or obligations for room and board. See ECF Nos. 2 & 3. Accordingly, Mr. Retamar has failed to demonstrate that he would have to forgo life's necessities if he paid the $402.00 filing fee, and the Court DENIES his motion to proceed in forma pauperis (ECF No. 2). All further proceedings in the matter shall be held in abeyance for twenty (20) days pending Mr. Retamar's delivery of the filing fee in the amount of $402.00 (money order, or bank or cashier's check made payable to the Clerk, U.S. District Court) to the Clerk's Office, 915 Lafayette Boulevard, Bridgeport, CT 06604.
