Filing 7 ORDER finding as moot #2 Motion for Leave to Proceed in forma pauperis. In light of Petitioner's July 26, 2022 payment of the filing fee, the #2 Motion for Leave to Proceed in forma pauperis is found as moot. Signed by Judge Victor A. Bolden on 7/29/2022. (Bartlett, H.) |
Filing 6 ORDER CONSOLIDATING HABEAS PETITIONS: The petitioner has filed two habeas petitions under 28 U.S.C. 2241 (3:22-cv-887 and 3:22-cv-888) which assert the same challenge and seek the same relief. Accordingly, the Court concludes that consolidation of 3:22-cv-887 with 3:22-cv-888 will serve the interests of justice. The Clerk's Office is respectfully directed to consolidate 3:22-cv-888 with case number 3:22-cv-887, which will serve as the lead case. Signed by Judge Victor A. Bolden on 7/29/2022. (Bartlett, H.) |
Filing fee received from George Hajati: $5.00, receipt number BPT13124. (Fanelle, N.) |
Filing 5 NOTICE OF INSUFFICIENCY. The petitioner has moved for leave to proceed in forma pauperis - in other words, he has asked the Courts permission to begin a habeas case without pre-paying the $5.00 filing fee. A federal law permits prisoners to begin actions without pre-paying the filing fee, provided that they submit an affidavit showing that they are unable to pay, along with a certified copy of their inmate trust account statement showing their account balance for the six months immediately preceding the habeas petition. 28 U.S.C. 1915. Here, the petitioner did not provide a certified copy of his trust account statement and therefore is directed to provide one by August 5, 2022. If he does not his case may be dismissed. Alternatively, the petitioner may pay the filing fee. He is respectfully advised that the filing fee for habeas matters is only $5.00, not the $402.00 Signed by Judge Thomas O. Farrish on 7/15/2022.(Corriette, M.) |
