ORDER granting in part ECF No. #12 , Motion to Continue Hearing. In this motion, Defendant asks the court to continue the preliminary injunction hearing currently scheduled for August 18, 2022, to delay the related briefing schedule, and to extend the time in which Defendant must respond to the complaint. There is no objection to the last request, and the court therefore will grant it. Defendant must file a response to the complaint on or before September 15, 2022.Plaintiff does object to the request to postpone the hearing, though, claiming it will be exposed to irreparable harm each day that Defendant continues in his current employment. However, the court finds that it is in the interest of justice to ensure Defendant is afforded sufficient time to prepare for the hearing, and a brief continuance will not unduly prejudice Plaintiff. Accordingly, it hereby is ordered that the preliminary injunction hearing is continued to August 30, 2022, at 10 a.m. Defendant shall file a response to the motion for a preliminary injunction on or before August 16, 2022.
