The filing fee is $402, and Plaintiff's financial affidavit lists income of $1,860 a month and a saving account balance of $5,000, with reported expenses of $2,985. Therefore, the court finds that Plaintiff is unable to pay the fees required to commence this action. Accordingly, the motion for leave to proceed in forma pauperis is GRANTED. Defendants have yet to respond to the complaint, thus the court is unable (at this early stage in litigation) to fully assess whether Plaintiff Nanette Mosley meets the threshold requirement that her claims are "likely to be of substance." See Hodge v. Police Officers, 802 F.2d 58, 61 (2d Cir. 1986). The request for counsel therefore is denied without prejudice. Additionally, this court lacks jurisdiction over housing matters in state court. Here, the plaintiff has submitted housing court documents dated August 4, 2022, in support of her request. And it appears that she is requesting federal court intervention to prevent her from being evicted. That is not possible because this does not involve a federal question or diversity of citizenship. Under the "well-pleaded complaint rule," federal jurisdiction "exists only when a federal question is presented on the face of a properly pleaded complaint."
