Filing 5 NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis. A federal law, 28 U.S.C. 1915, permits him to do so if, among other things, he files an affidavit demonstrating his inability to pay fees and a certified copy of his inmate trust account statement for the six month period preceding his complaint. To help incarcerated plaintiffs demonstrate an inability to pay, the court has prepared an application form. In this case, however, the plaintiff left all of the fields on the form empty, and he did not provide a certified copy of his inmate trust account statement.Incarcerated plaintiffs ordinarily seek in forma pauperis status to avoid having to pay the initial filing fee all at once. But there are other benefits as well for example, when a plaintiff qualifies for in forma pauperis status, officers of the court become responsible for service of process. See 28 U.S.C. 1915(d). In this case, the plaintiff evidently does not seek in forma pauperis status to avoid pre-paying the filing fee; he has said that he will pay the full $5.00 filing fee applicable to habeas matters, and he has executed a form directing the Bureau of Prisons to charge his trust account for that purpose. If he seeks the other benefits of in forma pauperis status, however, he must show that he qualifies, and he has not yet done so.The Clerk of the Court is respectfully directed to send the plaintiff a blank in forma pauperis application form at his address of record. If the plaintiff continues to seek in forma pauperis status, he must return a completed application form, along with a certified copy of his inmate trust account statement, to the Clerk of the Court by September 16, 2022.
