September 21, 2022 Opinion or Order Filing 9 ORDER granting ECF No. #8 , Motion for Extension of Time. In this motion, Defendant represents that defense counsel was only recently retained and requires additional time to prepare a response to the complaint. Although Plaintiff does not consent to the request, the court finds it in the interest of justice to grant it. Defendant shall answer the complaint on or before October 14, 2022. The court further notes that Defendant represents in this motion, and the docket reflects, that a summons in this action issued on August 23, 2022. See ECF No. #6 . It is not clear, though, when service was effected. Defendant's motion for an extension of time to October 14, 2022, to answer the complaint indicates that service was effected the same day the summons issued, but there is nothing on the docket showing proof of service, and Local Rule 4(d) requires plaintiffs to file such proof within seven days of receiving it.
