October 24, 2022 Opinion or Order Filing 9 ORDER. Federal Rule of Civil Procedure 81(c)(2) provides that a defendant who did not respond to a complaint before removing it to federal court must respond to the complaint within the longest of three periods: (1) 21 days after receiving a copy of the initial pleading; (2) 21 days after being served with the summons for the initial pleading; or (3) 7 days after the notice of removal was filed. Here, all Defendants except the unidentified John Doe Defendants were served with the summons and complaint in August of 2022, and the action was removed on September 1, 2022, but to date no Defendants have responded to the complaint. Accordingly, by October 31, 2022, the identified Defendants shall file a response to the complaint as well as a motion for an extension of time nunc pro tunc explaining why they failed to timely respond to the complaint.
