September 23, 2022 Opinion or Order Filing 6 ORDER denying Petitioner's Motion to Proceed In Forma Pauperis. ECF No. 2. In this habeas action filed on August 15, 2022, Petitioner seeks leave to proceed without paying the filing fee under 28 U.S.C. 1915. ECF No. 2. The Court considers whether information provided by Petitioner demonstrates that the burden of paying the fees for filing and service would hamper his ability to obtain the necessities of life or force him to abandon a potentially meritorious claim. Adkins v. E.I. Dupont de Nemours & Co., 335 U.S. 331, 339-40 (1948). Petitioner's inmate account statement shows that as of September 7, 2022, he had $58.05 in his account and an average 30 day balance of $71.53. See ECF No. 3. He also had deposits in the amount of $1,060 during the last six months. Id. Further, Petitioner indicates that he has no dependents. ECF No. 2. Thus, the Court concludes that Petitioner has failed to demonstrate that he would have to forgo life's necessities if he paid the $5.00 filing fee and DENIES his motion to proceed in forma pauperis. ECF No. 2. All further proceedings in the matter shall be held in abeyance for twenty (20) days pending Petitioner's delivery of the filing fee in the amount of $5.00 (money order or bank check made payable to the Clerk of Court) to the Clerk's Office, 915 Lafayette Boulevard, Bridgeport, CT 06604.
